MACH ONE™ EPOXY FLOORS (M1) WARRANTY INFORMATION & SERVICE TERMS

Plain Language

1. M1 will use the highest quality materials and professional-grade equipment using industry-standard or better processes.
2.  The resulting product should last a lifetime.
3. M1 can’t control underlying issues like concrete cracking, surface movement, and/or changes in moisture from beneath.
4. If our installation fails prematurely, we will fix it.

Legal Stuff

Price and Acceptance

1. Customer agrees to the price quoted, and all Terms and Conditions herein.
2. Changes to the proposal must be agreed to by both parties before work begins.

Cancellation

Should Customer cancel or postpone the installation within 24 hours of the agreed upon schedule, they may be subject to a Cancellation Fee of $650 unless M1 can find replacement projects for its crew.

Deposit and Payments

1. The customer agrees to the deposit percentage stated in the accepted proposal before work begins; the percent deposit can vary depending on the location and project.
2. Final payment is due immediately upon completion.
3. In the event the Customer Defaults in the making of any payments due pursuant to this Proposal, M1 may immediately seek all remedies allowed by law and charge 1.5% interest.
4. Customer agrees that it shall be responsible to pay all reasonable attorney’s fees and costs incurred by M1 in seeking to enforce the terms and conditions of this Proposal.
5. The Limited Lifetime Warranty from M1 will be effective upon completion of the project, after all payments due are received.

Surface Condition

1. While there is a certain amount of friction built within most coating systems, Customer acknowledges that floors may be inherently slippery when wet.
2. M1 can provide additional friction additives to help alleviate some but not all slipping, for an additional cost.
3. M1 is not responsible for any bodily injury caused by slipping or falling on your floor.

Vapor Barrier

1. Customer attests that an effective vapor barrier exists under the concrete.
2. In the event there is no vapor barrier present, M1 can add a moisture blocking primer prior to the coating to mitigate adhesion issues related to moisture, for an additional cost.
3. While M1 may test your concrete surface for a moisture reading, it is limited to a value at the time of the test and in no way guarantees there is need for a vapor barrier or moisture blocking costing.
4. M1 will not warranty the installation due to vapor transmission without the vapor barrier installed by M1.

Limited Lifetime Warranty

M1 warrants against labor and product defects for the lifetime of the surface, with the following exceptions:

1. “Lifetime” refers to the life of the product while owned by the Residential Customer.
2. Commercial Customers receive a three-year Limited Warranty.
3. M1 warrants all labor performed to be free of defects for a period of 3 years from date of installation of materials installed by M1.
4. Customer must report any suspected defects to M1 within the 3-year period.
5. Defects are to be considered blisters, peeling, or scaling of coating.
6. M1 shall, at its own discretion, take all steps considered reasonable and necessary to remedy the defect.
7. This warranty does not apply to any damages to the coating by physical abuse, failure of the substrate or structure, vandalism, modifications to the substrate or the coating being applied, mechanical impact damage, exposure to heat or flame, exposure to solvents and/or acids, gas or oil leaks, brake fluid, windstorms, proximity to salt water, lightning, nails, screws, plant life, animal activity, abuse of any kind, normal wear and tear, acts of God, and gradual color fading.
8. Cracking is not a warranted item as coatings do not stop the movement of the substrate.
9. This warranty does not apply to damage caused by hydrostatic water or moisture vapor permeating the concrete surface.
10. The warranty does not cover changes in oxidation of the coating as a result of normal weathering or atmospheric conditions.
11. The warranty does not apply to delamination due to improper substrate condition or an internal failure of the substrate.
12. This warranty does not apply to any wood surfaces, decks or pressure treated lumber.
13. This warranty does not apply to damage caused by cracks in the substrate prior to or occurring after the installation of the floor coating system that appear from ground shift and expansion/contraction of the substrate, cracking due to substrate movement is not under warranty regardless of whether same was repaired during original installation or not.
14. Areas repaired under this warranty may vary in color and texture from areas originally installed which are not repaired.
15. The Warranty is granted to the original purchaser and is not transferable to any other party nor to a subsequent purchaser of the property.

Remedy

M1 will remedy any defects in products during the warranty period, except for defects as outlined above.

Liability

1. M1’s liability shall not exceed the fees paid by the Customer to M1.
2. In no event shall M1 be liable for any indirect, incidental, consequential, special, or exemplary damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of this Agreement, regardless of legal theory or whether M1 was aware of the possibility of such damages.

Other Terms and Conditions

1. Proposals are good for 30 days.
2. The M1 preparation and installation process may at times cause minor damage.
3. Minor wall touch up of sheetrock, paint, trim, etc. may be necessary after completion and shall be the responsibility of the Customer.
4. At times some flake may get into the air ducts that may need to be blown out. We do our best to ensure we remove as much flake as possible.
5. Active work areas of M1 installation will be denied to other trades until product is fully cured.
6. It is the Customer’s responsibility to make the work environment ready for M1 by removing excessive dirt, debris, and other hindrances and to keep any water, oil, or other contaminants from entering the work area 48 hours before our work is to be performed and 24-36 hours after our work is completed depending on products used.
7. If M1 must remove any items from area being coated customer will be charged $125.00 per man hour for removal of items. This will be added to final installment payment. M1 will not be liable for damages caused by moving any items on Customer’s behalf.
8. Customer will refrain from using any fans, central vacuum systems, or any equipment that blows air in area being coated. This can cause coating to have a “fisheye” appearance.
9. Customer will refrain from all foot, pet, and vehicle traffic for a minimum of 24 hours after installation (or longer if disclosed in the Proposal by M1).
10. Customer should expect some expulsion of flakes during the cure period which can be sharp to the touch. Walking barefoot on the surface may cause minor cuts until the surface fully cures.
